This Privacy Policy explains how Resound Networks, LLC (“Resound,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes information from or about you, your household, and devices associated with you when you are a prospective customer or when you subscribe to, access, or use our products, services, websites, and applications (collectively, the “Services”).

This Privacy Policy is intended to be referenced by, and incorporated into, our Terms of Service and any applicable customer agreement(s). If we update this Privacy Policy, we can do so independently from other contractual terms, unless applicable law requires otherwise.

1. Scope / What This Policy Covers

This Privacy Policy applies to information we collect from or about you in connection with:

  • establishing or maintaining an account;
  • providing internet access, voice/VoIP, and other services we may offer;
  • providing customer support and service operations;
  • operating and securing our networks and systems; and
  • marketing and advertising activities as described below.

Third-party services. Sometimes you may access websites or services that Resound does not own, manage, or control. This Privacy Policy does not apply to information collected by third parties through their own websites, applications, or services.

2. Information We Collect

We may collect the following categories of information, depending on how you interact with us and which Services you use. Resound collects and processes data solely as necessary to deliver, support, secure, and bill for Business Services and to comply with applicable law. Resound collects only the information reasonably necessary to provide, support, secure, and bill for Services.

A. Information You Provide to Us (“Customer-Provided Information”)

We may collect information you provide when you establish an account, request service, subscribe, pay for services, or contact us, including:

  • Contact information (e.g., name, address, email address, phone number);
  • Account credentials and authentication information (e.g., usernames, passwords, and other authenticating information);
  • Identification and verification information (e.g., driver’s license photo or other government identifier, where collected for credit evaluation, fraud prevention, or account verification);
  • Payment information (e.g., debit/credit card information or bank account information);
  • Service and account information (e.g., subscribed services, orders, configuration choices, and settings); and
  • Customer communications and interactions (e.g., call center interactions, online chat sessions, in-person interactions, community support, and interactions through our social media accounts).

B. Information We Collect Automatically

When you access or use the Services, we may automatically collect:

  • Device and network identifiers and technical information, including device identifiers, IP address, network addresses, operating system, and technical configuration information;
  • Network traffic and usage data, including information about your use and the operation of Services and network performance/support data;
  • Information about devices connected to our network, including number, type, and status of devices connected to our network (as applicable);
  • Geolocation information (general and/or precise), including location inferred from network connections or devices where applicable; and
  • Operational and diagnostic data to maintain, troubleshoot, and improve our Services.

Note on communications/services requiring storage/transfer. Certain services may require Resound to transfer or store communications (for example, a Resound email account or a voice product that includes voicemail). Where applicable, we may collect and process the contents necessary to provide those Services.

C. Location Information

Depending on the Services, we may collect or use:

  • Service address (home and/or business) to deliver Services at a fixed location;
  • General or precise location information when you access Services;
  • Call detail information (e.g., call connection locations such as city/state/country, and call origin/destination locations) for account administration and billing (where applicable); and
  • Public IP address and related device/network information for authentication and for features such as security, parental, or device controls (where applicable).

D. Information We Obtain From Third Parties

We may receive information from third parties, such as:

  • Credit reporting agencies (for creditworthiness, credit score, or credit usage, where applicable);
  • Data verification sources to confirm information you provided;
  • Content and platform providers when you access Services through another provider’s platform or device; and
  • Analytics, research, and marketing partners (including demographic or interest-based data, depending on applicable law and your choices).

3. How We Use Information

We may use the information we collect to:

  • Provide, operate, maintain, and improve our Services and related systems and networks;
  • Create and administer your account, including activation, billing, invoicing, payment processing, and collections;
  • Authenticate you and manage access to the Services;
  • Provide customer support, including quality assurance (which may include recorded or monitored communications where permitted by law);
  • Configure, manage, and customize Services and related settings (including device management features, where offered);
  • Protect security and integrity, prevent fraud, detect unauthorized reception, use, or abuse of Services, and enforce applicable terms and policies;
  • Maintain records for accounting, tax, and business administration; and
  • Comply with applicable laws and regulations and respond to lawful requests.

We may also use certain information to:

  • Market and advertise our products and services; and
  • Deliver relevant advertising (including targeted or cross-context behavioral advertising) as described below, subject to applicable law and your choices.

4. Monitoring, Network Protection, and Content Handling

Resound takes customer privacy seriously, and we do not have a general obligation to monitor content. However, to operate and protect our networks and Services, we may monitor, review, retain, restrict access to, or disclose information (including network traffic/usage information and content residing on Resound systems) when we believe it is reasonably necessary to:

  • comply with applicable law or valid legal process;
  • enforce our agreements or policies;
  • detect, prevent, or address security, fraud, or technical issues; or
  • protect the rights, property, or safety of Resound, our customers, our personnel, or the public.

5. How We Disclose Information

We may disclose information as follows:

A. To Account Holders and Authorized Users

We may disclose certain information about an account and use of Services to the primary account owner, and to other authorized users, only after appropriate authentication.

B. To Service Providers (Vendors)

We may disclose information to service providers that perform business functions on our behalf, such as:

  • billing and collections;
  • payment processing;
  • analytics and research;
  • marketing and advertising;
  • service delivery, customization, maintenance, and operations; and
  • fraud prevention and security.

Service providers are authorized to use personal information only as necessary to provide services to us.

C. For Legal Process and Government Requests

We may disclose information to comply with valid legal process (e.g., subpoenas, court orders, warrants) and as otherwise required by law. Where permitted and appropriate, we may (but are not required to) provide notice to you so you may seek to object or take other action.

In some instances, applicable law may require disclosure without notice to you.

D. To Protect Rights, Safety, and Property

We may disclose information when we believe disclosure is necessary to protect customers, employees, or property; respond to emergencies; or enforce our rights in court or otherwise for violations of applicable terms, conditions, or policies.

E. Business Transfers

If we enter into a merger, acquisition, or sale of all or a portion of our assets, we may transfer information as part of that transaction.

6. Sale/Sharing for Advertising; Targeted Advertising; Your Choices

We may, subject to applicable law and your choices:

  • sell or share personal information with third parties (including advertising partners) for their own marketing, advertising, or other commercial purposes; and/or
  • use information to provide targeted or cross-context behavioral advertising.

This may include sharing or selling persistent identifiers (such as device identifiers and IP address), internet usage data, and general or precise geolocation data.

Opt-out. Depending on your state of residency, you may have the right to opt out of:

  • sale of personal data,
  • sharing of personal data for targeted/cross-context behavioral advertising, and/or
  • targeted advertising.

Where required by law, we will obtain your consent before selling or sharing your personal information.

Global Privacy Control (GPC). Where required by applicable state privacy law, you may opt out by broadcasting a universal opt-out signal such as the Global Privacy Control (GPC) through supported browsers and/or extensions, or by going to: https://globalprivacycontrol.org/ 

7. Data Security

No method of transmission or storage is completely secure. We maintain administrative, technical, and physical safeguards designed to protect information we maintain. However, we cannot guarantee absolute security. Customers are responsible for maintaining the security of their own devices and networks, including use of firewalls, antivirus, and other protective measures.

8. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide Services, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary based on the type of information and applicable legal requirements.

9. Children / Minors

Our Services are intended for U.S. residents and are not directed to children. Where required by law, we will obtain parental consent before collecting certain protected data from users under the age of 13.

10. Users Outside the United States

Our Services are meant for residents of the United States. If you use our Services outside the United States, you understand and consent to the transfer, processing, and storage of your information in the United States, where laws may differ from those in your country.

11. State-Specific Privacy Rights

Depending on your state of residency, you may have additional privacy rights, which may include the right to:

  • access/know the personal data we collect about you;
  • correct inaccurate personal data;
  • delete personal data (subject to exceptions);
  • obtain a copy of certain data (data portability);
  • opt out of targeted advertising and/or certain profiling; and
  • opt out of sale or sharing of personal data (as defined by applicable state law).

You also have the right not to be discriminated against for exercising applicable privacy rights.

California (CCPA/CPRA)

Only California residents have the rights listed below under the California Consumer Privacy Act and Proposition 24 (“CCPA/CPRA”). A California resident is a natural person (as opposed to a corporation or other business entity) who resides in California. California residents may have rights including:

  • right to know/access;
  • right to delete;
  • right to correct;
  • right to limit use/disclosure of sensitive personal information (where applicable);
  • right to opt out of sale/sharing; 
  • right to non-discrimination;
  • right to correct inaccurate personal information on file with Resound; and
  • right to limit the use and disclosure of sensitive personal information collected about them.

If Resound chooses to sells any California customer’s personal information, Resound will provide notice prior to the sale/at collection of information and will provide a Do Not Sell or Share link.  At this time, Resound does not sell California residents’ information. 
We will verify your identity and may require additional information to process your request. We will respond within legally required timeframes (generally 45 days, with extensions where allowed).

12. Federal Privacy Notices (If Applicable)

A. Cable Communications Policy Act (Section 631)

If you subscribe to certain cable video and telecommunications services or other services provided using the facilities of the Resound network, federal law may provide additional rights regarding personally identifiable information (“PII”), including rights to know, access, and correct certain records, and limits on collection and disclosure.

To request access to PII we maintain pursuant to the Cable Act, contact your local Resound office or call the number on your monthly billing statement to schedule an appointment during normal business hours. We may charge reasonable costs for retrieval and copying where permitted.

B. Communications Act (Section 222) / CPNI (If Applicable)

Depending on the Services you obtain, Resound may have obligations to protect the confidentiality of Customer Proprietary Network Information (CPNI) related to certain telecommunications services. We will authenticate your identity before disclosing CPNI to you or your authorized agent where required.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version through the applicable website or other method we use to provide legal notices. If changes materially affect your rights or the ways we use or disclose information, we will attempt to provide advance notice through written, electronic, or other means using contact information associated with your account, where required or appropriate.
